Crisis Looms In Orhuwhorun Over Alleged Illegal Sales of Land by Udu Councilor, Takerere, Bokor, Others

…Oyibode, Udu Monarch Urged To Intervene

By Sunday Apah

Crisis is currently looming in Orhuwhorun town, Udu Local Government Area, following the alleged illegal sale of Orhia land by a serving Councilor, Hon. ThankGod Agolokigho, HRH Ighohwo Takerere, Chief Moses Bokor and Chief Apine Layer.

It would be recalled that Hon. ThankGod Agolokigho, HRH Ighohwo Takerere, Chief Moses Bokor, Chief Apine Layer, VIC Land & Property Limited, and others have been summoned to the High Court of Justice, Oror-Udu, in suit No: OUHC/208/2025 by Pa Jude Rewa Okolosi, Mr. Ator Okolosi for Uterhi gate of the Ekrekun family; Pa Dodor Chabor, Mr. Friday Ovedje for themselves and on behalf of Atare gate of the Ekrekun family; Mr. Ochuko Jeroh, the Oghwuvwie of Ekrekun for himself and on behalf of Ovuokporho/Okporho gate of the Ekrekun family; and Mr. Jonathan Arutare for himself and on behalf of Umurhieri of the Ekrekun family as claimants.

They claimed in the suit that Hon. ThankGod Agolokigho, HRH Ighohwo Takerere, Chief Moses Bokor, and Chief Apine Layer, the defendants, suddenly broke into and entered the land without consent or permission from the claimants and sold the same to VIC Land & Property Limited, the 6th defendant.

According to the suit, the four sub-families of the Ekrekun family/quarter in Orhuwhorun are entitled to the customary ownership of the particular portion of land in dispute and/or the large tract of land comprising the entire Orhia/Urhude/Urhode Bush/farmland situate and being at Orhuwhorun Town in Udu Local Government Area of Delta State, a place well known to the defendants in this suit.

The claims include: – “An order nullifying whatever purported sales and/or transfers by the defendants to third parties, as the same are void ab initio.

“An order of perpetual injunction restraining the defendants, by themselves and/or through their agents, servants, privies, or anyone claiming through them, from illegally destroying, attempting to sell, defacing, and/or entering the land in dispute and/or the entire Orhia/Urhude/Urhode Bush/farmland property of the claimants/Ekrekun family, within the jurisdiction of this Honourable Court, and a place well known to the defendants.

“The sum of N23,280,000 (Twenty-three million two hundred and eighty thousand Naira) as special damages, and the sum of N5,000,000,000 (Five billion Naira) as general damages, for the cost of the claimants’ property/crops destroyed, emotional and psychological trauma, and expenses incurred as a result of the trespass.”

The defendants, having been threatened with the implications of the suit, allegedly decided to devise means to impeach the Oghwuvwie in order to facilitate their alleged illegal sale of the land.

It was men of the Nigeria Police Force, who were detailed to the community on Monday night, that brought the situation under control.

A reliable source who don’t want his name in print told DAILY SHINE NEWS that an Oghwuvwie cannot be removed by mere announcement, as the present constitution of Orhuwhorun community provides a process that must be followed.

“The President General of the community must be notified and must give approval before any removal can take place, based on proven offenses against the Oghwuvwie.

The source called on the members of the Board of Trustees of Orhuwhorun Community, the Chairman of Udu Local Government Area, Chief Vincent Oyibode, and the Ovie of Udu Kingdom to intervene in the issue for a peaceful resolution to avert any breakdown of law and order.

Delta Government Supports Anioma State Creation Within Constitutional Framework — DTSG

By Sunday Apah

The Delta State Government has affirmed that it has no objection to the formation of Anioma State, provided that the process adheres strictly to constitutional provisions.

This stance was communicated on Monday during a peaceful demonstration by Anioma youths representing the nine local government areas of Delta North, who gathered at the Government House in Asaba to renew their petition for the establishment of Anioma State and its allocation to the South-East geopolitical zone.

Speaking to the protesters at the Government House gate, the Chief of Staff, Prince Johnson Erijo, reassured them that Governor Sheriff Oborevwori’s administration respects the legitimate aspirations of the Anioma people.

He reiterated the government’s commitment to democratic principles, the supremacy of the rule of law, and the expression of the popular will.

Prince Erijo praised the youths for maintaining a peaceful and disciplined demonstration, highlighting it as evidence of their dedication and maturity in pursuing their cause.

He revealed that the governor had been fully informed about the protest and had tasked him with engaging the group personally to hear their concerns.

The Chief of Staff acknowledged that the call for the creation of Anioma State is reasonable and properly articulated, deserving earnest consideration.

Drawing on a biblical analogy, he emphasized that governments have a duty to respond to the sincere needs of their citizens, stating, “No earthly father would give a stone to a child who asks for bread.”

He further stressed the importance of unity among the Anioma people, pointing out that a clear, shared position would strengthen their campaign and help avoid divisions. “If the people agree on the Anioma they want, dissenting voices should have no place,” he noted.

Explaining the constitutional process for creating a new state, Prince Erijo outlined that it involves submitting petitions and memoranda to the National Assembly, legislative deliberations, and ultimately a referendum.

He clarified that such a referendum would encompass all Anioma-speaking areas, including Aniocha North and South, Oshimili North and South, Ika North East and Ika South, Ndokwa West and East, as well as neighboring communities like the Igbanke in Edo State.

He assured the demonstrators that if a referendum showed majority support for the new state, their wishes would be honored.

Prince Erijo reiterated that Governor Oborevwori does not oppose the creation of Anioma State and will back any lawful outcome that reflects the majority will.

He thanked the youths for their peaceful conduct and encouraged them to remain law-abiding as they continue advocating for Anioma State, assuring that the government will respect any consensus reached by the people.

Earlier, the youths, united under a coalition, restated their demand for the creation of Anioma State and its zoning to the South-East geopolitical zone. They emphasized their ancestral, cultural, and linguistic ties as Igbo people, insisting that their identity should be recognized and respected.

Representatives including Ofochi Atagana (Ukwuani youths), Ayo Ashiedu (Aniocha North), Kingsley Kainebi (Ika North East), and Chief Jude Ogbekile (Igbanke community) appealed to the Delta State Government for political and moral backing of their cause.

While acknowledging that the process of state creation is constitutionally regulated, they highlighted the pivotal role of governors in advancing such initiatives.

The youths described the creation of Anioma State as mutually beneficial, noting that Asaba would naturally serve as the capital of the new state, while Delta State could designate a new administrative center elsewhere.

Calling on President Bola Ahmed Tinubu and members of the National Assembly to support the Anioma State bill, they pledged to remain steadfast in their quest to reunite with their relatives across the Niger River.

…Rescue 18 Kidnapped Victims, Recover N36 Million, 28 Vehicles, Guns, Ammunitions

By Sunday Apah

The Police in Delta State have arrested 627 suspected kidnappers, armed robbers, cultists, rapists, and murderers, rescued 18 kidnapped victims, and recovered 28 vehicles, several guns, ammunition, and other weapons from January 2025 to date.

The Commissioner of Police, Delta State Command, Abaniwonda Olufemi, announced this during a press briefing on Monday in Asaba, the state capital.

He stated that two suspects in the murder of retired Justice Ifeoma Okogwu at her residence on November 24, 2025, were arrested on December 6, 2025, based on credible intelligence.

He explained that operatives of the Homicide Section, State CID, Asaba, arrested Godwin Mngumi, a 25-year-old male security guard attached to the deceased’s residence.

“The suspect was found in possession of one of the late Justice’s mobile phones. Upon interrogation, he voluntarily confessed and admitted inviting his accomplice, Nnaji Obalum, a 21-year-old male, to perpetrate the crime,” he said.

The suspects confessed that on November 23, 2025, at about 9:30 p.m., they, along with a third suspect currently at large, entered the deceased’s home, tied her with rope and cloth, and murdered her.

They thereafter stole her valuables, including two phones and a wristwatch, which they disposed of for a meagre sum. One of the stolen phones has been recovered in Ogbogonogo market, Asaba.

Also, on 1st December 2025, at about 0230 hrs, operatives of the Command State Anti-Cult Unit (SACU), in collaboration with community volunteers, were on intensive patrol when they received credible intelligence that suspected kidnappers were sighted within the Obiaruku forest.

Acting swiftly, operatives of SACU stormed the bush, where the suspects opened fire from multiple directions in a bid to repel the team.

The operatives responded with superior firepower, leading to the death of one suspect, while others escaped into the forest with varying degrees of gunshot injuries. One AK-47 rifle with forty-two (42) rounds of live ammunition, nine mobile phones, and charms were recovered.

In a similar operation, on 6th December 2025 at about 0730 hrs, operatives of the CP-Special Assignment Team (CP-SAT), acting on credible intelligence, executed a successful intelligence-led operation in Abraka.

The operatives conducted a coordinated search at Umeghe community, Abraka, at the residence of Isiakpere Friday, male, 67 years old.

The operation resulted in the recovery of two (2) pump-action guns and thirty-nine (39) live cartridges. The suspect is in custody, and an investigation is ongoing to determine possible links to cult groups, arms suppliers, and other criminal networks.

In another development, operatives of the CP-Special Assignment Team (CP-SAT) recorded a series of coordinated breakthroughs between 28th and 29th November 2025 in ongoing efforts to dismantle criminal networks linked to armed robbery and cult-related activities across Ughelli, Oghara, and Sapele.

Acting on credible intelligence around the Ekuigbo axis, the team intercepted Kelvin Oke, male, 42 years old, and recovered a stolen tricycle in his possession.

Further coordinated operations led to the arrest of two additional suspects: Victor Oyaye, male, 26 years old, identified as the gang leader, and Monday Emakpo, male, 31 years old, residing in Agbarha, Ughelli. Another stolen tricycle and a locally made shotgun loaded with six live cartridges were recovered.

Also, on 10th December 2025 at about 2130 hrs, the Deputy Commissioner of Police in charge of Operations led a formidable contingent of policemen drawn from the Buffalo Tactical Teams to Agbor, Ika South LGA, Delta State, where they conducted a decisive raid on a hideout known for notorious sales and distribution of illicit drugs.

The intelligence-driven operation resulted in the arrest of one hundred and sixty-one (161) suspects, comprising one hundred and ten (110) males and fifty-one (51) females.

A large quantity of illicit drugs was recovered from the hideout, including Nigeria Loud, Canadian Loud, CSC Codeine, Ice, and sachets of 200 mg of Tramadol. Similarly, on 13th December 2025, operatives of Buffalo intercepted an Asaba-Onitsha bus at the Head Bridge, Asaba, and subjected it to a search during which one hundred and nine (109) bottles of codeine and cartons of tramadol were recovered. The suspects were promptly arrested, and investigation is ongoing.

“In line with the mandate of the Inspector-General of Police, IGP Kayode Egbetokun, PhD, NPM, to ensure a safe, peaceful, and crime-free environment across the country, I have directed officers and men of the Delta State Police Command to remain proactive, professional, and fully committed to the protection of lives and property across the state.

“This commitment has, within the year under review, resulted in the recovery of a total of one hundred and forty-four (144) firearms, comprising twenty-seven (27) AK-47/AK-49 rifles, twenty-five (25) Beretta pistols, fifty-six (56) single-barrel and locally fabricated cut-to-size guns, and thirty-six (36) pump-action guns;

“In addition, the Command recovered six thousand nine hundred and thirty (6,930) rounds of ammunition/cartridges, significantly degrading the operational capacity of criminal elements.

“Furthermore, the Command recorded the arrest of over six hundred and twenty-seven (627) suspects, which includes one hundred and forty (140) suspected armed robbers, one hundred and thirteen (113) suspected kidnappers, one hundred and twenty-five (125) murder suspects, one hundred and eighty-seven (187) suspected cultists, sixty-two (62) suspects arrested for rape and defilement offences, and thirty-six million naira (#36,000,000) ransom recovered within the period under review.

“AK-47/AK-49 rifles recovered were 27, Beretta pistols 25, single-barrel/cut-to-size guns 56, pump action guns 36, ammunition and cartridges 6,930; ransom recovered N36,000,000.

“Suspects arrested include 140 armed robbers, 113 kidnappers, 125 murder suspects, 187 cultists, 62 rape/defilement suspects, 18 rescued kidnapped victims, and 28 vehicles recovered,” he added.

Abigborodo Community Decries Neglect in Ongoing Pipeline Projects By SEPLAT’s

0

…Calls for Enforcement of Inquiry Recommendations

By Sunday Apah

The Abigborodo community in Warri North Local Government Area has expressed strong concerns about SEPLAT Petroleum’s ongoing pipeline projects, accusing the company of neglecting their rights as hosts to significant oil installations in OML 41.

During a press conference held at the town hall, community representatives criticized SEPLAT for proceeding with new pipeline installations without proper consultation, despite numerous petitions and documented proof of land ownership in Ugbekoko, Uton Iyatsere, and Abigborodo spanning several years.

They highlighted that both the Petroleum Industry Act of 2021 and the Host Communities Development Regulations of 2022 clearly mandate oil companies to engage meaningfully with their host communities.

According to the community leaders, SEPLAT has disregarded these legal requirements, effectively sidelining the people.

The community referred to several government documents, including the Delta State Judicial Commission of Inquiry into the Okpe Sobo Forest Reserve, published in Gazette No. 1 of 2021, which confirmed Abigborodo’s ownership of the land in question.

They expressed disappointment that the state government has yet to implement the white paper from that inquiry, which recommended recognition and fair compensation for the community.

Additionally, the leaders cited the Peace Building and Conflict Resolution Committee’s findings, which investigated grievances against SEPLAT and affirmed that Abigborodo and Ugbekoko qualify as host communities.

They lamented that the committee’s recommendations remain unfulfilled, leaving the community marginalized and vulnerable.

“The initiation of pipeline operations without resolving existing disputes is deeply concerning,” the community stated, cautioning that such actions could escalate tensions and provoke social unrest in the Niger Delta.

Responding to reporters, the chairman of the Abigborodo Management Committee drew parallels to the broader Niger Delta crisis that prompted the amnesty program, noting the underlying issue was the violation of community rights. He warned that without proper engagement from SEPLAT, the situation may worsen.

He called on the Delta State governor to take prompt and decisive measures by enforcing the white paper and the peace-building committee’s recommendations. “Leadership demands clear choices—either implement the proposals or reject them outright. Ignoring them only leaves communities in uncertainty,” he emphasized.

The community outlined their key demands: an immediate halt to pipeline operations until thorough consultation occurs; security forces should not be used to suppress peaceful demonstrations; and the federal government, Nigerian Upstream Petroleum Regulatory Commission (NUPRC), and other relevant bodies must intervene to safeguard Abigborodo’s rights.

In conclusion, community representatives reaffirmed their commitment to peaceful and lawful advocacy for their land rights but warned that continued neglect could intensify poverty and threaten stability in the Niger Delta.

They appealed to the media for broad coverage of their situation and urged the government to act swiftly to avert further conflict.

According to him, “Since our maiden meeting on March 23, 2025, this movement has grown in numbers, vision, and influence.

“We started with a simple yet powerful idea — that political relevance must not be concentrated in a few hands but should flow from the grassroots where the people truly reside.

“We are delighted to welcome members and leaders from existing political pressure groups who have recognized the value in our vision and chosen to join forces with the Ughelli South Political Colonels.

“Together, we shall consolidate our political strength and speak with one voice for the benefit of our people.

“My dear brothers and sisters, the Ughelli South Political Colonels is not just another group — it is a movement for unity, relevance, and progress.

“The work ahead is enormous, but with our shared vision and unwavering determination, we shall succeed.

“Let us continue to build bridges, foster understanding, and promote collective progress. Together, we will ensure that Ughelli South remains politically vibrant, respected, and adequately represented in all spheres of governance.

“We recognize President Bola Ahmed Tinubu and Governor Sheriff Oborevwori as the leaders of our group and will work tirelessly to ensure their re-election.”

Earlier, in their related speeches, Mr. Simon Umudi (aka Temple), Administrative Head; Deacon Matthew Kwode, Publicity Secretary; Chief Frank Ugen, Special Adviser; Chief Francis Aguonigho, Chief Adviser; Chief Efeviroro Edjuto; Chief Mrs. Lizzy Unurhoro, Assistant Women Leader, Chief Mrs Josephine Oromata, Women Leader of the group, Chief Isaiah Kekeje, Chairman of the APC in Ughelli South LGA, stated that the USPC has become the leading grassroots political force within the APC in in the LGA and Delta State on general.

“It is renowned for principled leadership, inclusive governance, grassroots mobilization, and the promotion of sustainable development in Ughelli South LGA and beyond,” they added.

They emphasized that the USPC is focused on mobilizing grassroots participation through political education and community engagement, advocating for governance that addresses real issues and delivers measurable results.

According to them, “The USPC is rooted in principles of discipline, loyalty to party ideals, inclusive participation across age, gender, and class, as well as transparency, accountability, and issue-based politics.

“Our membership is open to all registered APC members in Ughelli South LGA who align with the group’s vision and support the candidacy of President Bola Ahmed Tinubu and Rt. Hon. Sheriff Francis Orohwedor Oborevwori, Executive Governor of Delta State, for the forthcoming 2027 general elections.”

Rt. Hon. Francis Ejiroghene Waive, in his response, appreciated the group for making him their ambassador, noting that the group is composed of politicians of high repute.

He also thanked the group for the support given to him during and after his election and promised to continue to be their voice at the National Assembly.

He urged the group to continue its drive for new members, as politics is all about numbers and majority.

Waive emphasized the urgent necessity for all eligible voters in Ughelli South LGA to embrace the ongoing voter registration exercise.

He warned that low registration and turnout undermines the district’s influence in elections and could lead to weakened representation at both state and federal levels.

Waive stressed that a robust voter base is vital to ensure that the voices of the federal Constituency residents are heard and their interests properly advocated.

Waive appealed to party leaders, community elders, youth groups, and the general populace to mobilize efforts at the grassroots level to encourage wider participation in the registration drive.

Mrs. Helen Adjekawen, who spoke on behalf of the new entrants, pledged their allegiance and full support to the Ughelli South Political Colonels.

They assured the USPC leadership of their unwavering support, vowing to work tirelessly for a total victory for President Bola Ahmed Tinubu and Governor Sheriff Oborevwori in the upcoming elections.

Ughelli South Council Chairman Donates Desks to Eghereka Primary School in Ewu

The Executive Chairman of Ughelli South Local Government Council, Olorogun Dr. Lucky Avweromre, has donated new desks to Eghereka Primary School in Ewu-Otor.

The donation was prompted by a viral video showing some pupils at Eghereka Primary School sitting on the floor, highlighting a shortage of classroom furniture.

While the video drew widespread attention, it coincided with ongoing efforts by councilors from each ward, who had been mobilized earlier to provide chairs and tables to primary schools as part of the council’s priority projects for the outgoing fiscal year.

Mr. Aaron Joseph Okenaberhie, the Council’s Supervisor for Education, formally presented the desks to the school’s management on behalf of the council chairman on Friday, December 12, 2025, urged the school authorities and community leaders to ensure proper care and maintenance of the newly supplied furniture.

Commenting on the situation that led to the lack of desks at Eghereka Primary, Mr. Okenaberhie described it as an act of deliberate sabotage.

He emphasized the need for relevant community stakeholders to prevent negligence and vandalism of government properties going forward.

The desks were received by Mr. Samuel Abido, Local Education Authority (LEA) Secretary, represented by Mrs. Erhugberume Juliana, and Miss Ojo Helen, who represented the school’s headmaster.

Comrade Daniel Etaga who was also on ground, expressed gratitude to the council chairman for his prompt response in addressing the needs of the pupils at Eghereka Primary School.

Also, Hon. Henry Gbejimor, personal assistant to the council chairman, encouraged the school management to put the desks to good use to benefit the pupils.

2027: Ughelli North APC Leaders Pledge to Secure Victory for Tinubu, Oborevwori, All Party Candidates in 2027

By Sunday Apah

Key All Progressives Congress (APC) leaders from Ughelli North Local Government Area, Delta State, on Friday gathered at the country home of Ughelli North LGA Chairman, Olorogun Jaro Egbo, in Uduere to expressed a firm commitment to ensure the success of President Bola Tinubu, Governor Sheriff Oborevwori, and all APC candidates in the 2027 general elections.

The landmark meeting—marked as the first since the unification of political structures—brought together prominent party figures who collectively affirmed messages of solidarity, unity, and determination to achieve electoral success.

At the event, APC founding member in Delta State and key leader in Ughelli North, Olorogun O’tega Emerhor, hailed Governor Oborevwori’s and the entire PDP’s integration into the APC as “the dawn of a new era.”

He emphasized that the merger had strengthened the party’s position for political dominance.

Emerhor commended the strong sense of unity currently evident within the party and urged both elected officials and political appointees to render full support as the APC prepares for forthcoming elections.

The meeting’s host and Ughelli North LGA Chairman, Olorogun Jaro Egbo, remarked that the party was gearing up for the 2026 electoral season with renewed vigor, stressing APC’s determination to dominate the political landscape in Ughelli North.

Egbo encouraged members to persist in recruiting new supporters, highlighting that Ughelli North holds the largest voter population in Delta State.

He noted that the unity demonstrated at the gathering sent a clear signal of loyalty to both President Tinubu and Governor Oborevwori.

“As a party, we must all work together to ensure the victory of every APC candidate in the 2027 elections,” he declared.

Also, Ughelli North APC Chairman, Hon. Samuel Evwighono, described the occasion as historic, pointing out that it was the first time the entire party structure had assembled since the merger.

Evwighono shared that his appointment as chairman was “miraculous” and accepted “by grace,” noting that one of his initial goals was to reconcile dissatisfied members and foster greater party unity.

However, he raised concerns regarding the low number of Permanent Voters Cards (PVCs) collected from the INEC office in the area and urged party leaders to encourage full participation in the ongoing voter registration exercise.

Chief Press Secretary to the Delta State Governor, Sir Festus Ahon, appealed for unity and unwavering support for President Tinubu and Governor Oborevwori, emphasizing that Ughelli North, as the governor’s hometown, must spearhead efforts to strengthen the APC.

Other participants included Prof. Sam Ibodje; Hon. Matthew Omonade, representing Ughelli North Constituency I in the Delta State House of Assembly; Commissioner for Transport, Hon. Onoriode Aguofure; Surveyor Terry Noah; and all 11 APC ward chairmen.

They collectively affirmed their loyalty and commitment to the party, vowing to deliver electoral success for all APC candidates in 2027.

The meeting concluded with renewed enthusiasm as party members pledged to consolidate the APC’s influence ahead of the upcoming elections.

REJOINDER: RESPONSE TO ZIK GBEMRE’S CLAIMS ON OLOROGUN KENNETH GBAGI’S FAMILY AND CHIEF EMUOBOH GBAGI’S STATUS

0

By Barrister Johnson for the Gbagi Family

Our attention has been drawn to the statement made by Mr. Zik Gbemre, dated December 7th 2025, in which he attempted to discredit the rightful position of Chief Emuoboh Gbagi and to distort the facts concerning the family of the late Olorogun Kenneth Gbagi. Observably, Mr. Zik Gbemre appears to have been co-opted by his wife who has portrayed herself long before now immediately preceding the demise of Olorogun Kenneth Gbagi, as having been hired by Hon. Justice Sybil Gbagi, to unjustifiably, but virulently attack the person of Chief Emuoboh Gbagi. While it may not be desirable to join issues and trade words with Mr. and Mrs. Zik Gbemre, their actions and roles of busybodies crying more than the bereaved, which they have arrogated to themselves, and which with respect to say the least, unfortunate compel this rejoinder. For the avoidance of doubt, we hereby set the records straight, both in law and in Urhobo custom:

This response is grounded in Urhobo customary law, Nigerian statutory law (including the Marriage Act, Evidence Act, and Companies and Allied Matters Act), judicial precedents, and verifiable facts about the Gbagi family structure. The following points systematically address and refute Mr. Gbemre’s assertions, affirming Chief Emuoboh Gbagi’s rightful position and protecting the integrity of the late Kenneth Gbagi’s legacy.

(i) Evelyn’s Status as First Wife: Separation Does Not Constitute Divorce

Mr. Gbemre’s claim that Evelyn Gbagi, mother of Chief Emuoboh Gbagi, is a “former wife” due to her separation and alleged remarriage to a Mr. Turner Darryl is baseless and legally incorrect. Under Nigerian law, specifically the Marriage Act (Cap. M6 LFN 2004), a statutory marriage remains valid until dissolved by a court-issued decree absolute, as affirmed in Obusez v. Obusez (2007) 10 NWLR (Pt. 1043) 430. Separation, whether prolonged or not, does not terminate a marriage in the absence of judicial intervention. Evelyn and Kenneth Gbagi were married under both statutory and customary rites, with no evidence of divorce proceedings or a decree absolute. Urhobo customary law, as recognised in Eshiet v. Eshiet (2001) 4 NWLR (Pt. 702) 162, similarly upholds the validity of a prior marriage unless formally dissolved.

Allegations of bigamy are speculative and lack substantiation under the Evidence Act (Sections 82-90), which requires concrete proof to challenge marital status. Evelyn remains Kenneth Gbagi’s first and legal wife, entitled to reside in the family home and enjoy spousal rights under Section 18 of the Married Women’s Property Act and Urhobo customs, which protect the principal wife from eviction post-husband’s death. Mr. Gbemre’s suggestion to “settle” Evelyn elsewhere violates these legal and cultural protections, constituting the true taboo.

(ii) Evelyn as Mother of Eight Children and Legally Recognised First Wife

Mr. Gbemre’s attempt to diminish Evelyn’s status by implying she is a concubine or “former wife” ignores documented evidence. Evelyn is the mother of eight children by Kenneth Gbagi, including Chief Emuoboh, and is the first and legally recorded wife in all official documentation, including marriage certificates, family registries, and corporate records. Under the Legitimacy Act (Cap. L6 LFN 2004) and Urhobo customary law, as affirmed in Ukeje v. Ukeje (2014) 11 NWLR (Pt. 1418) 384, all children born within a valid marriage are legitimate heirs with equal inheritance rights, irrespective of their mother’s designation as wife or “osen.”

The Supreme Court in Ukeje struck down discriminatory practices but upheld equality among legitimate heirs, reinforcing Evelyn’s children’s rights, with Emuoboh as the eldest gate. Kenneth Gbagi himself introduced Emuoboh as his senior son, a fact verifiable by family members, the public and consistent with the Evidence Act’s presumption of legitimacy (Section 165). Mr. Gbemre’s challenge to Emuoboh’s seniority lacks legal or cultural grounding and disregards the burden of proof required to contest legitimacy.

(iii) Evelyn’s Contributions to Kenneth’s Business Empire vs. Sybil’s Exclusion

Mr. Gbemre’s narrative omits Evelyn’s significant role in Kenneth Gbagi’s business empire, which underscores her legal and equitable status as the first wife. Evelyn served as a Director and shareholder in several of Kenneth’s companies particularly GKO Properties Limited, with her contributions documented in Corporate Affairs Commission (CAC) filings pursuant to the Companies and Allied Matters Act (CAMA) 2020 (Sections 271-279). These filings recognise spousal contributions to marital property as joint assets, as seen in Awojugbagbe Light Industries Ltd. v. Chinukwe (1995) 4 NWLR (Pt. 390) 379.

In contrast, Hon. Justice Sybil Gbagi, a recent customary wife—akin to an “osen” or concubine in Urhobo parlance—played no role in building these investments and was never included as a director or shareholder. Kenneth, a seasoned lawyer, deliberately excluded Sybil from these corporate structures, reflecting her secondary status. Under Urhobo customs and equitable principles, Sybil’s lack of contribution limits her claims to personal maintenance, not proprietary interests, reinforcing Evelyn’s foundational role.

(iv) Sybil’s Lawsuit as a Cultural and Legal Abomination

Mr. Gbemre’s defence of Hon. Justice Sybil Gbagi’s lawsuit to claim the Abuja residence and Oginibo country home is misguided and contradicts Urhobo customary law. As a childless customary wife, Sybil’s attempt to assert next-of-kin status over ancestral and communal properties violates Urhobo traditions, which, per The Urhobo People by Ogheneakpobor (2006) and Lewis v. Bankole (1909) 1 NLR 82, reserve custodianship for the senior legitimate son or principal heirs. Chief Emuoboh Gbagi occupies this role lawfully and customarily.

The Oginibo ancestral compound and permanent family homes in Abuja are not for personal ownership, but by custom remain under the custodianship of the senior son for the benefit of the entire family. Such claims by a non-procreative wife are taboo, disrupting ancestral lines. Any attempt by Sybil, George, or Michael to appropriate these properties for themselves is contrary to both Urhobo custom and the equitable distribution of inheritance. Sybil’s lawsuit is frivolous and outrightly an overreach. Publicly exhibiting this lawsuit, as Mr. Gbemre suggests, would expose its cultural and legal invalidity, not Emuoboh’s actions.

(v) Emuoboh’s Legitimate Seniority and the Ulterior Motives of Sybil’s Supporters

Chief Emuoboh Gbagi’s resistance to Mr. Gbemre’s claims is rooted in Urhobo customs taught him by his father, Kenneth, and affirmed by the head of the Gbagi family who recognises Emuoboh as the senior son, as introduced by Kenneth during his lifetime. Chief Emuoboh Gbagi was introduced personally by his father during his lifetime to the family and the Urhobo community as the senior son and custodian of the family compound. This recognition carries full weight under Urhobo custom.

By contrast, George and Michael—now being packaged by Sybil—were never declared or introduced by Kenneth as biological/senior sons respectively during his lifetime. In fact, Mr. Gbemre may pretend not to be aware that George contested for the position of House of Assembly member in Ethiope East Constituency in the 2023 general elections in the name of GEORGE OGHENEKEVWE EMUERO under the platform of Social Democratic Party (SDP). Where doubts exist as in this instance, DNA testing can be undertaken, but even if proven, they take their place after the last recognised child, as Urhobo tradition requires that only sons openly acknowledged by the father during his lifetime may assume ancestral leadership.

In conclusion, Zik Gbemre’s publication is misleading, defamatory, and a distortion of both law and Urhobo custom. The facts remain:

– Evelyn is the first and legal wife, mother of eight children, and long-standing partner in Kenneth’s business life.

– Chief Emuoboh is the recognised senior son and custodian of the family homes.
